Agency relationships

Tenant Representation

We act solely in the best interest of you, the Tenant.

  • Duties: Loyalty, Confidentiality, & Negotiation.
  • Broker Fee: Paid by the Tenant, unless a Landlord agrees in writing to cover it.

Landlord Representation

We act solely in the best interest of the Landlord (property owner).

  • Duties: Marketing, Presenting Applicants, & Negotiation.
  • Broker Fee: If the Landlord pays, this must be disclosed upfront.

No Dual Agency (Rentals Only)

We cannot represent both the Landlord and the Tenant in the same rental transaction. You will always confirm who we represent before services begin.

Open Listings

Many properties are listed by multiple brokers. The broker who secures the first approved application earns the commission. This is why you may see the same property advertised by different firms.

Agreement terms

  1. 1. Exclusive Representation

    You choose Luna Realty as your agent, and we work only for you while this agreement is active.

    You (the Tenant) grant Luna Realty the exclusive right to locate or procure rental housing acceptable to you. During the term of this agreement you agree to work with Luna Realty on your rental search, to refer potentially acceptable properties to us, and to let other real estate agents who contact you know that Luna Realty represents you. Whether any property is acceptable is always solely your decision.

  2. 2. Broker Fee

    If we introduce you to a place and you're approved for it, the fee is one (1) month's rent — unless the landlord has agreed in writing to pay it.

    Real estate fees are fully negotiable and are not fixed or set by law. In consideration for our services, you agree to a broker fee of one (1) month's rent, due upon approval of your rental application or lease offering for a unit that Luna Realty introduced to you — unless the landlord has agreed in writing to pay the fee, in which case you owe nothing. Every listing shows who pays the fee before you apply. Payment is due by check, cash, or card at the time of that event.

  3. 3. Units Covered

    This covers any home we show you or give you access to — in person, virtually, or through private listing feeds.

    This agreement applies to all properties shown or made available to you by Luna Realty, whether in person, virtually, or by providing access to private or open listings (including MLS, YGL, and similar broker feeds).

  4. 4. Our Services & Duties

    We use reasonable efforts to find you a home, arrange showings, help you negotiate, follow Fair Housing law, and keep your information confidential.

    Luna Realty agrees to use reasonable efforts to locate housing acceptable to you and to assist you in negotiating the terms of a lease, including arranging showings and advising on real estate practices and procedures. We comply with all applicable federal, state, and local Fair Housing laws. We will preserve your confidential information, disclosing it only as necessary to establish your financial qualifications to a landlord. You understand that landlords are not required to keep the existence or terms of an application confidential unless a confidentiality agreement is made in advance. You also understand that Luna Realty represents other tenants, and that introducing another prospective tenant to a property you are interested in — or assisting another tenant — is not a breach of our duty to you. These services are not a guarantee or warranty concerning any property.

  5. 5. Your Duties

    Work with us during the term, share the financial info we need, and remember we are not your attorney or inspector — do your own due diligence.

    During the term you agree to work with Luna Realty on your rental search, to conduct negotiations with our knowledge and assistance, to cooperate by providing relevant personal and financial information, and to help schedule and attend showings. You agree to tell us about any property you were previously introduced to by another person, and you represent that you are not subject to an earlier exclusive agreement with another broker. You understand that Luna Realty has not been retained as an attorney, inspector, or surveyor, gives no legal advice, and has no duty to investigate conditions outside a property's boundaries (such as neighborhood, crime levels, or the presence of sex offenders). This agreement does not relieve you of the duty to exercise due diligence for your own protection; we recommend you hire an attorney or other professionals as you see fit.

  6. 6. Term & Cancellation

    This runs 120 days. You can cancel in writing before you submit an application.

    This agreement is effective for 120 days from the date you sign it, unless extended in writing. You may cancel before submitting a rental application by giving written notice. The broker fee is still due if you lease, or are approved for, a property that Luna Realty introduced to you before you cancelled. If, within 60 days after this agreement ends, you lease a property that we introduced during the term, the fee remains due.

  7. 7. If You Are Not Approved / Refunds

    We work off approval. If you aren't approved and no tenancy is created, every amount you paid is refunded in full — unless you gave false information or acted wrongfully. If you are approved, what you paid is applied under the payment terms you accepted at checkout.

    Luna Realty works on the basis of approval. If your rental application is not approved and a tenancy is not created, you are entitled to a full refund of all amounts you previously paid to Luna Realty. No refund is due if you have made a false statement, intentionally omitted requested information, or committed another wrongful act. If your application is approved, amounts you have paid are applied and handled in accordance with the payment terms presented and accepted at checkout.

  8. 8. Disputes & Governing Law

    Massachusetts law governs. Fee disputes go to REALTOR®/AAA arbitration; this is the entire agreement between us.

    This is the entire agreement between you and Luna Realty and may be modified only in a writing signed by both parties. It is governed by the laws of the Commonwealth of Massachusetts and binds the parties’ heirs, successors, and representatives. Any fee dispute or claim arising from this agreement will, on demand of either party, be submitted to binding arbitration through the local or state Association of REALTORS® or, if it declines, the American Arbitration Association, held in Massachusetts. Reasonable attorneys’ fees and costs are awarded to the prevailing party, including under a claim brought under Massachusetts General Laws Chapter 93A. This document creates binding legal obligations; for legal advice, consult an attorney.

Common questions

What exactly am I signing?

Your Luna Realty representation & fee agreement (Massachusetts-compliant). It does two things: it discloses who our brokers represent under Massachusetts law, and it sets the terms of us working for you as your tenant’s agent — including how the broker fee works.

Why does Massachusetts require this?

Massachusetts requires licensed brokers to disclose their agency relationship and how fees work before helping you with a specific rental, so you know who is on your side before you tour or apply.

What is the broker fee and how much is it?

one (1) month's rent — but only if you apply and are approved for a unit Luna Realty introduced to you, and only unless the landlord has agreed in writing to pay it. Every listing shows who pays the fee before you apply, and many are no-fee.

When would I actually pay?

Only upon approval of a lease offering for a unit we introduced. Browsing, touring, and applying cost nothing.

Can I cancel this agreement?

Yes. It runs 120 days, and you can cancel in writing before you submit an application. The fee still applies if you lease or are approved for a place we introduced before you cancelled.

Is signing with a checkbox or typed name legally binding?

Yes. Federal (ESIGN) and Massachusetts (UETA) law recognize typed and click-to-adopt electronic signatures. We record the method honestly, timestamp it, and seal the PDF with a SHA-256 fingerprint and a QR verification link.

Who can see this agreement?

You and your assigned Luna Realty agent. Property managers on units you apply to only see that it is signed — never the document itself.

How do I get a copy?

Right on this page: once signed, a “View PDF” button appears at the top, and anyone can confirm the document is authentic at the QR verification link stamped on it.
